Texas Court Temporarily Blocks Woman Diagnosed with Trisomy 18 from Emergency Abortion

Texas Abortion Acts and the Issues
The Texas Supreme Court has temporarily stopped a 31-year-old pregnant woman, Kate Cox from having an “emergency abortion” on Friday, November 8th, 2023 after she had obtained an order from a lower court.

District Court Judge Maya Guerra Gamble, a lower court in Texas, has on Thursday granted an order to Kate Cox [alone] to abort her 20 weeks pregnancy after she was diagnosed with Trisomy 18, a genetic abnormality that usually results in miscarriage, stillbirth, or death soon after birth. The District Court Judge did not expand abortion access broadly.

The court order obtained by Kate to abort her 20-week pregnancy was opposed by Texas Attorney General Ken Paxton following the “near to complete ban” the state placed on abortion overturning the nationwide constitutional right to abortion.

The case between the Texas Attorney General and Kate Cox could be considered as an acid test for the ban Texas placed on abortion which leave narrow chances for women to have abortion. The exceptional conditions where abortion could be granted to pregnant women, according to the Texas Abortion Act, is to save the mother’s life or prevent substantial impairment of a major bodily function.

Kate Cox had wanted to abort the pregnancy so she wouldn’t go through a cesarean to give birth to a baby that would still not live. She said this may affect her ability to give birth to more children which she and her husband want.

A senior staff attorney at the Center for Reproductive Rights, Molly Duane fears while they still hope the Court will reject the state’s request, justice delayed might still be justice denied.

Paxton argued that “Nothing can restore the unborn child’s life that will be lost as a result of abortion. Doctors who perform abortion risks several penalties including life imprisonment and loss of their licenses.
