Photo Credit: Sahara Reporters Following the political development in the Peoples Democratic Party (PDP) where some members of the party, including Senator Chimaroke Nnamani from Enugu West Senatorial District, were expelled from the party for anti-party activities, the Labour Party has approached the court to compel the Independent National Electoral Commission (INEC) to remove the name of Senator Chimaroke Nnamani from the ballot.
The litigation by the Labour Party against Senator Nnamani is expected but the timing might be considered wrong and unproductive.
The fact remains that the Constitution of the Federal Republic of Nigeria has stipulated that no person can vie for an elected office without being sponsored by a political party.
The point of contention here that may invalidate the litigation brought up by the Labour Party against Senator Nnamani is that he has already been sponsored by his party, PDP, and his expulsion may remain an object of the Court since he has personally rejected the expulsion.
Knowing fully well that the political party does not have the right to remove the name of any candidate that has been sponsored by the party and submitted to INEC, except if the candidate is dead or voluntarily writes INEC to withdraw from the race, the Labour Party ought to have to wait till after the election when it would have been cleared on whether Senator Nnamani would approach the court on this issue or not, and the position of the court would have been known to all by then.
By now, the Labour Party might have just run experimental political litigation which may judiciously give the party no tangible results. Recall that nomination of candidates is an internal affair of a political party, the application filed by the Labour Party may considerably be thrown out for lack of jurisdiction which might have been set aside if the party had waited for the right time to approach the court.
