Nasir Yusuf Gawuna and Abba Kabir Yusuf The streets of Kano City were kept busy with a mammoth crowd of people protesting the anticipated removal of the Kano State Governor Abba Kabir Yusuf of the New Nigeria People's Party (NNPP) by the Supreme Court of Nigeria.
The loyalists of the near-to-be-impeached Governor staged the protest to influence judgment of the Supreme Court which has reserved judgment in the litigation that followed the March 18th, 2023 Governorship Election in the state.
Recall that the Supreme Court of Nigeria on December 21, 2023, reserved judgment in the Governorship Election case between Governor Abba Kabir Yusuf of the NNPP and Nasir Gawuna of the All Progressives Congress (APC).
Although Abba Kabir Yusuf lost the case at both the Tribunal and the Court of Appeal, the protesting supporters of the NNPP want the Court to set aside the two rulings, and affirm Yusuf as the winner of the election.
Arguably, Abba Kabir Yusuf has lost the litigation for a clear constitutional reason, remembering that he has been unable to prove his case in the lower courts.
Gawuna of the APC had challenged the victory recorded by Yusuf in the said election, claiming he did not score up to the score awarded to him by the Independent National Electoral Commission (INEC).
Gawuna proved his case by stating, that the ballot papers used at some Polling Units where Yusuf claimed to have scored maximum votes were not stamped or signed by the electoral officers of the INEC.
Interestingly, the Constitution mandates the stamping and signing of every ballot paper to be used for the Nigerian election by the designated INEC official. Otherwise, the votes are void and null.
Unfortunately, the supporters of Abba Kabir Yusuf capitalized on the discrepancies between the Certified True Copy (CTC) issued by the Court of Appeal that heard the case and the oral judgment delivered in the courtroom.
Strange though the Court has since corrected the anomaly it is now a burden on the Supreme Court of Nigeria to decide whether this "strange" error" is enough to subdue the evidence of election rigging as has been proofed by the Gawuna APC or shield Yusuf from impeachment as a result of the error the court has expressed as "human error".
Unfortunately, the protest that rocked Rogo Local Government Area yesterday was against a Police order which ban any form of protest in the state. Besides, the protest that commenced with a prayer session later turned chaotic after some people set ablaze a car in the process of the protest.
