Why Supreme Court May Order Fresh Election in Kano

One of the interesting post-governorship election litigations is the Kano State Governorship Election Petition Tribunal.

Recall that the Kano State election petition tribunal and the court of appeal have ruled in favor of the governorship candidate of the All Progressives Congress (APC), Nasiru Gawuna as the duly elected candidate in the March 18th, 2023 governorship election.

There is a very great possibility that the Supreme Court will want to stay neutral, and it must deliver a judgment on the said case. This simply means the hands of the apex court in the country are tied concerning the Kano State Governorship Election Petition Tribunal.

Although the Round Table reported that the Supreme Court has fixed a date for the hearing of the Kano State Governorship Election Petition appeal to the apex court, the Supreme Court will still be very careful in delivering judgment, and this may only be achieved by sending all the parties in the case to the battlefield again, however, the rerun election may be contested between the two parties.

You may be wondering about the reasons that may be so difficult for the Supreme Court to decide in this litigation, which may warrant it to order a fresh election in Kano State.

First, it is very important to recall that the APC has a very good case against the New Nigeria People's Party (NNPP), and the APC is definitely on the run to win, except for a peculiar situation that now makes the case very difficult for the Supremes Court to decide.

Arguably, no court will deduct NNPP's votes at all the polling units being challenged by the APC.

Recall that the claim by the APC is that the ballot papers used at those polling units being challenged were not signed by the Independent National Electoral Commission (INEC) which is against the provisions of the 2022 Electoral Act as amended.

However, the discrepancies between the Certified True Copy (CTC) and the oral judgment delivered by the Court of Appeal on the Kano State Governorship Election Petition is a major setback that may cancel the advantage APC has in the case.

Today, purposely for political biases, many people who are opposition to APC, and not members 9f NNPP are in support of the first CTC released by the Court of Appeal, and even if the Supreme Court uses the second CTC to justify the validity of APC case, they will be called names and crucify despite knowing that APC has a very good case which would be won at any court of Justice.

To resolve the election litigation without creating many problems for the Court of Appeal and the Supreme Court in the future, the Supreme Court may be silent on the discrepancies in the Appeal Court ruling and order for a rerun election in the state.
