Barr. Hudu Yunusa Following failure of the electoral umpire in Nigeria, the Independent National Electoral Commission (INEC) to successfully conclude the March 18th governorship election in Adamawa State, the electoral commission postponed the election to Saturday, April 15th 2023.
After the Saturday's poll, the state Returning Officer, Prof. Mohammed Mele, suspended the collation of the election results on Saturday and postponed it till 11am on Sunday.
Surprisingly, the Adamawa state Resident Electoral Commissioner (REC), Barrister Hudu Yunusa, was said to have been allegedly broke into the same collation centre around 9 am on Sunday and declared Binani the winner of the election.
Following the odds occurrence with the announcement of election result and declaration of Aisha Binani as the Adamawa State Governor-elect, many citizens including those who are not residents in Adamawa State have been condemning the at, asking for an outright sack of the Resident Electoral Commissioner, Barr. Hudu Yunusa by the commission.
Regardless of what level of justification anyone may have against Barr. Hudu, the Independent National Electoral Commission (INEC) and its National Chairman lack competence to sack any State Resident Electoral Commissioner of the Commission.
In fact, it is important to note that the same constitutional provision guides the appointment and dismissal of the National Chairman and State Resident Electoral Commissioner of INEC.
Regardless of what offence a REC might have been caught with, Section 6 subsection (3) Part 1 of the 2022 Electoral Act as amended is very clear about the ways to go, in the course of relieving a REC of his appointment.
The electoral act provides that a Resident Electoral Commissioner can only be removed by the President, acting on the address supported by two-thirds majority of the Senate. Also, the constitution requires that the REC must have been established to have failed to perform his function of office or an offence.
So, it is a waste of time and demand for uncertainty if people still want INEC of its National Chairman, Prof. Mahmood Yakubu to each Barr. Hudu because of what happened in Adamawa State which has not even been established to be an offence.
